Professional Experience
Mr. DiLucente has over 30 years of consulting experience providing financial, accounting, and economic assistance to clients involved in a wide variety of business disputes. He has provided legal counsel and their clients assistance relative to all aspects of the commercial litigation process including providing expert testimony in federal, state and bankruptcy courts as well as in national and international arbitration proceedings. He has also served as a mediator.

Areas of Expertise
During his career, Mr. DiLucente has participated in, and supervised, a variety of engagements that have involved general, as well as specialized, assistance to clients. This experience has allowed him to gain an understanding of the mechanics and processes of a wide variety of industries, including banking and commercial lending, charter schools, non-profits, securities, coal mining, renewable energy, waste management, insurance, professional practices, health care, real estate development, manufacturing, recycling and construction, among others.

With respect to commercial disputes, Mr. DiLucente’s experience includes, but is not limited to, accounting, economic and financial fact finding, calculating and critiquing claims for lost profits and economic damages, performing business and asset valuations, calculating damages associated with intellectual property, evaluating eminent domain issues, assessing joint ventures, partnerships and cooperatives, among other endeavors. With respect to industries served, Mr. DiLucente’s experience is varied and includes work relative to heavy manufacturing, coal mining, oil and gas, dairy, waste management, non-profits, gas drilling, insurance, retail, commercial arms, professional practices, health care, real estate as well as banking and commercial lending, among other environments.

Mr. DiLucente has significant experience in the bankruptcy environment. This experience has encompassed a wide variety of issues and includes working for secured and unsecured creditors as well as other stakeholders. His experience includes development of claims to be submitted in bankruptcy, developing and reviewing liquidation plans, developing and reviewing plans of reorganization and performing analyses regarding claims of fraudulent conveyance. He has been inserted into various operations as the point person to monitor cash flow on behalf of bankrupt entities including approving cash disbursements and serving as signatory on all outgoing checks/wires. He has also assessed industry and project specific conditions relative to the possibility of various stakeholders filing for bankruptcy. Mr. DiLucente has testified in bankruptcy courts regarding various issues including plans of reorganization, related party contracts and other arrangements. This testimony has been in Chapter 11 and Chapter 7 proceedings and has involved many industries including construction, medical care, retail and manufacturing.
